Foreword :
These general terms and conditions of sale and internal and external regulations are applicable to the booking of rooms and apartment and additional services made with Mas Gardane (operated by Mas Gardane S.à r.l., represented by Cathy Dropsy and Guibert Richard, hereinafter the operator). Le Mas Gardane offers 5 guest rooms and an apartment (hereinafter the accommodation or the establishment). These terms and conditions were sent to you by e-mail (or email) a few days before your arrival, SMS or WhatsApp. They are those in force at the date of confirmation of your reservation on all the different sites offering the services, including the www.masgardane.fr site and the reseller sites (Booking.com and maison d'hôtes). They cancel and replace all general terms and conditions of sale and internal and external regulations previously published online and/or accepted by the customer. They are deemed to have been read and accepted by the customer at the time of booking online or by telephone. Any confirmed reservation implies acceptance of the general conditions of sale and internal and external regulations

Stay :
The customer signing the contract must be over 18 years of age (legal majority in France). The customer enters into the contract for the duration specified at the time of booking and may not, under any circumstances, claim any right to remain in the premises. If you wish to extend your stay, this will be done in consultation with the operator according to availability.

Reservations :
Reservations can be made by telephone (+33 7 89 73 85 38), on the www.masgardane.fr website or via the booking sites subscribed to by the operator.

Withdrawal period :
In accordance with article L 121-20 of the French Consumer Code, all consumers have a period of 7 days from the date of booking to exercise their right of "retraction", without having to justify their reasons or pay any penalties, with the exception of return costs if any. This right of withdrawal must be made by telephone or e-mail (or email), failing which the reservation will be considered valid and payment of the deposit will be due by the customer.

Conditions of sale :
Bed and Breakfast ("Accommodation"):
1. All reservations must be guaranteed by a credit card valid on the date of the beginning of the stay, unless otherwise indicated.
2. 30% deposit on reservation;
3. Balance of stay to be paid 2 days before start of stay;
4. Customer cancellation policy:

o Stays of less than 3 nights:
 Cancellation free of charge up to 7 days before arrival.
 Less than 7 days before arrival: 50% of deposit retained.
 In the event of non-arrival by 8:00 pm on the day of arrival, the deposit will be retained in full and the balance of the stay will be invoiced. The reservation is cancelled and the accommodation will be re-let.

o Stays of more than 3 nights:
 Cancellation free of charge up to 15 days before arrival.
 Between 5 and 15 days before arrival: 50% of deposit retained.
 Less than 5 days prior to arrival: full deposit retained and payment of 50% of the balance.
 In the event of non-arrival by 8:00 p.m. on the day of arrival, the deposit will be retained in full and the balance of the stay will be invoiced. The reservation is cancelled and the accommodation will be re-rented.

Apartment :
1. All reservations must be guaranteed by a credit card valid on the date of arrival, unless otherwise indicated.
2. 30% deposit on reservation;
3. Balance of stay to be paid 5 days before start of stay;
4. A deposit of EUR 500 must be paid 5 days before the start of your stay;
5. Cancellation policy for the customer:

o Stays of less than 7 nights :
 Cancellation free of charge up to 5 days before arrival.
 Less than 5 days before arrival: 50% of deposit retained.
 In the event of non-arrival by 8:00 pm on the day of arrival, the deposit will be retained in full and the balance of the stay will be invoiced. The reservation is cancelled and the accommodation will be re-let.

o Stays of more than 7 nights:
 Cancellation free of charge up to 15 days before arrival.
 Between 5 and 15 nights: 50% of deposit retained.
 Less than 5 days prior to arrival: full deposit retained and payment of 50% of the balance.
 In the event of non-arrival by 8:00 p.m. on the day of arrival, the deposit will be retained in full and the balance of the stay will be invoiced. The reservation is cancelled and the accommodation will be re-let.

Booking confirmation :
Reservations are deemed final upon confirmation by e-mail (or email) from the operator ([email protected]).

Reservation contract :
The customer certifies the accuracy of the information provided in the online or telephone reservation. The reservation becomes effective once the customer has paid by credit card the deposit corresponding to 30% of the total cost of the reservation. The customer will receive an e-mail confirming the terms of the reservation. The balance must be paid before the stay or on site.
For any other booking services in addition to those for nights, breakfasts and dinners, which cannot be made online, the customer will contact the operator directly by e-mail (or email) or telephone to obtain a quote based on the services requested.

Cancelling a reservation :
Reservations may be cancelled in accordance with the terms set out in the general terms and conditions. This cancellation request must be made either by telephone or by e-mail. Cancellation is deemed final upon confirmation by e-mail (or email) from the operator.

Cancellation by the operator :
When the operator cancels a stay, it must inform the customer by e-mail (or email). Without prejudice to any claims for damages, the customer will be reimbursed immediately for any sums paid. The customer will also receive an indemnity at least equal to the penalty that would have been incurred if the cancellation had been made by the customer on the same date.

Rates
Rates are per night per accommodation for 1 or 2 people. It is not possible to add an extra bed in the accommodation, including breakfast (except for the apartment). The accommodation is not suitable for young children, and we do not have suitable equipment. Tourist tax is not included.

Tourist tax
The tourist tax is a local tax that customers must pay to the operator, who then passes it on to the public treasury. It is currently set at €0.61 per night and per adult (&/or= 18 years old), for the total duration of the stay. It is payable by the customer on presentation of the invoice, in addition to the price of the night's stay.

Payment methods
The operator accepts payment by bank transfer, credit cards (Visa and Mastercard) and cash (€).

Opening hours :
 The operator is available every day by telephone from 8:00 am to 8:00 pm
 Check-in from 4:00 pm to 7:00 pm. For arrivals outside these times, please contact the operator by telephone.
 Reservations are guaranteed until 8:00 pm. You must notify the operator of any late arrival. Failing this, the reservation will be cancelled and no refund will be made. The accommodation will be relet.
 Check-out of accommodation must be no later than 11:00 am. Check-out is between 9am and 10.30am. For departures outside these times, please contact the operator. Late departures will be charged at EUR 50. For departures after 1:00 pm, an additional night will be charged. For departure before 9:00 am, please contact the operator.
 Breakfast times: 8:00 am to 10:00 am. For other times, please contact the operator.
 Table d'hôtes: service from 7:00 pm to 9:30 pm. Reservations required 24 hours in advance.

Possibility of having a simple meal after 9:30pm, please contact the operator before 8pm.
No-shows for table d'hôtes will be billed to the customer.

Police form

Foreign guests (who do not hold a French identity card or passport) must complete and sign an individual police form on arrival, as required by law. Children under the age of 15 may appear on the card of an accompanying adult. We must keep the form for 6 months and hand it over to the police or gendarmerie at their request. If the foreign guest refuses to fill in or sign the individual police form, the operator has the right to refuse him/her access to the tourist accommodation.

Pets
Pets are accepted on request, subject to prior approval by the operator. Please note that only one pet per accommodation will be accepted. The entire garden is not accessible to pets, but a special area has been set aside for them. Pet owners are asked to pick up after their pets, and a special garbage can is provided in the pet area. Your pets must not be left free in the accommodation when you are away (for breakfast, for example) or when you leave the establishment. In the event of damage caused by a pet on the property, the owner will be billed for the cost of repairing the damage.

Personal information
Pursuant to Law No. 2018-493 of June 20, 2018 on the protection of personal data and the General Data Protection Regulation (RGPD), the customer is informed that the information provided at the time of booking is subject to the processing of personal data for the purposes of reservation and customer management, billing and payment requirements, as well as for commercial prospecting purposes.
During their stay, customers may find themselves photographed or filmed at events organized and attended by them. For commercial purposes, these photos and/or films may be published on Mas Gardane's social networking sites: website, Facebook, Instagram, LinkedIn, etc. Customers have the right to access, rectify and delete their personal data.
They are therefore invited to inform the establishment's operator during their stay of their refusal to be filmed or photographed. They may also exercise this right by writing after their stay to the following e-mail address: [email protected] or by post to the following address: Mas Gardane S.à r.l.

Insurance
The operator declares that he has taken out specific insurance cover for "Bed and Breakfast and Furnished Accommodation" with an insurance company, the description and policy number of which can be provided on request.
The customer is responsible for all damage caused by himself, his companions or any animal under his responsibility. They should therefore check whether their main home insurance policy includes a holiday rental extension. The customer certifies that he/she is covered by a civil liability insurance policy covering his/her own liability, that of his/her pet and that of the persons accompanying him/her.
However, the operator and/or its insurance company reserve the right to hold the customer liable in the event of damage, malice and/or negligence on the part of the customer.

Disputes
These terms and conditions of sale are governed by French law.
It is recommended to favor the amicable settlement of disputes by having the object of the dispute recorded on the same day, for immediate resolution or as soon as both parties deem reasonable.
If the customer makes a complaint after leaving the establishment, he/she has 7 days in which to do so, either :
 by post by registered letter with acknowledgement of receipt to Mas Gardane S.à r.l.,

 or by e-mail to [email protected]. The operator undertakes to acknowledge receipt of the claim within 72 hours of the date of receipt of the email.
After this time, no claim may be made.
If the complaint is made within 7 days of the customer's departure, the establishment will deal with it within a maximum of 14 days following the complaint, in order to reach an amicable resolution in line with the interests of both parties.
Please note that after having referred the matter to the establishment within 7 days, and failing a satisfactory response within 15 days, the customer may refer the matter to the Médiateur du Tourisme et du Voyage, whose contact details and procedures are available on its website:

If the dispute persists, only the courts having jurisdiction over the head office of Mas Gardane S.à r.l. may hear the case.

Internal and external regulations :
 A non-exhaustive summary of the internal and external regulations is posted in the accommodation and common areas.
 The operator and his staff carry out a daily cleanliness check to make sure you have everything you need and to check that everything is running smoothly (emptying garbage cans and renewing linen and towels if necessary, etc.).
 It is forbidden to eat outside products or meals in the accommodation (except in the apartment), on the terraces and outside except in the poolhouse. Barbecues may be used (between May 1 and September 30) at the guest's own risk.
Guests may use the refrigerators in the poolhouse.
 The operator (licence III holder) also sells wine and beer to accompany the table d'hôtes or as an aperitif, so if customers wish to bring their own wine, the operator will charge a corkage fee of EUR 7 per opened bottle or 6-bottle pack of beer. It is forbidden to consume alcoholic beverages above 18° inside or outside the premises (licence IV).
 For the protection of minors, the sale and consumption of alcohol is forbidden to minors under the age of 18.
 Breakfast and table d'hôte meals are not served in the accommodation, but in the dining room or on the terrace.
 In compliance with decree no. 2006-1386 of November 15, 2006, smoking is prohibited in public areas. For reasons of safety, hygiene and comfort for all guests, all accommodation and communal areas are non-smoking. Smoking is permitted outside, with due respect for other guests. Cigarette butts may not be thrown into the garden, for reasons of safety and pollution. Ashtrays are available for smokers.
 The towels provided in your accommodation are for toilet use only. If you do not have a towel for the pool, we can provide you with one on request for the duration of your stay.
 The swimming pool is equipped with a child safety barrier. The operator reminds all guests that the pool is unsupervised. As the pool is a family pool, its use is reserved exclusively for members of the operator's family and for people staying in accommodation. Children under the age of 15, unaccompanied by a parent of legal age, are not permitted access to the pool area. Children's use of the pool is under the full supervision and responsibility of their parents. All noisy games and throwing of objects are forbidden in and around the pool, as are diving and jumping from the edge. It is forbidden to run around the pool. The pool is not heated.


Pool users agree to :
o take a shower before bathing and avoid swimming after using sun cream or oil.
o enter the pool area wearing sandals suitable for this purpose (no street shoes).
o to use a bathing suit reserved exclusively for swimming. It is forbidden to swim without a bathing suit.
o not to bring food or drink onto the beach.
o the pool area is open to guests from 8am to midnight.
o We accept no responsibility for guests not using the pool for swimming.
o For the sake of hygiene and peace of mind, we regret that we are unable to accept pets on the pool deck. Pets are permitted in the poolhouse.


 Personal belongings are the responsibility of guests, whether in their accommodation or outside, and we cannot be held responsible for any theft. There is no safe in the accommodation.
 In the event of loss or damage to the keys (to the accommodation and to the front door) and to the remote control for the entrance gate, a flat-rate charge of EUR 50 will be billed to the customer.
 A television is available to all guests in the living room until 23:00.
 Free internet access provided by the operator. The customer undertakes to ensure that the computer resources made available to him are not used for fraudulent or illegal purposes, and in particular in order to commit any act of infringement of third-party rights, piracy and/or illegal downloading protected by copyright or neighboring rights sanctioned by the Intellectual Property Code. Use of the Internet, downloads and visits to websites are the sole responsibility of the customer and those accompanying him/her. The choice to use the establishment's wifi is made under the sole responsibility of the customer and releases the operator from any liability concerning its use. The operator will do its best to provide an efficient Internet connection throughout the stay. The operator cannot be held responsible for the debit provided by the internet provider. No compensation will be paid in the event of an Internet connection failure due to the network provider.
 Accessibility for people with reduced mobility, for safety reasons linked to the conformity of the site, we are unable to accept people with reduced mobility and have no legal obligation to do so.
 Children are welcome in the property and in the house under the sole responsibility of their parents, bearing in mind that the property has potentially hazardous areas (stairs, road access, swimming pool, stove, barbecue, pigsty, poolhouse, barn and workshop).
 Heating systems, the property is equipped with radiators and/or reversible air conditioning. The customer is asked to use them with due care. The operator reserves the right to correct the use of the heating system.
 Sanitary installations, some sanitary facilities and WCs are equipped with lifting pumps or sanibroyeurs which do not allow tampons, towels, paper tubes, wipes, cotton pads etc. to be thrown into them, on pain of immediate breakdown. Whatever the equipment, it is forbidden to throw tampons, towels, paper tubes, wipes, cotton pads etc. into the toilets or washrooms. The operator reserves the right to invoice you at the actual cost of intervention, repair or replacement for any malfunction or breakage of the sanitary installations.
 Noise level: after 10 p.m. we ask you to keep the noise level down (music, voices, movements, etc.) out of respect for other customers and/or neighbors. Night-time noise regulations also apply during your stay.
 Capacity: the contract is drawn up for a specific number of people. If the number of guests exceeds this number, or does not comply with the terms of the reservation, the operator is entitled to refuse additional guests. This refusal can under no circumstances be considered as a modification or breach of contract on the operator's initiative, so that in the event of the departure of a greater number of customers than those refused, the price corresponding to the cost of the accommodation remains the property of the operator.
However, depending on the nature of the disagreement, the operator may propose an amicable solution to suit both parties, subject to availability (rental of additional accommodation, for example).
 Accommodation is neither a hotel nor a public place. It is a private place for family use. It is not open to the public. Nor can you bring your family or friends, even if you rent accommodation from us without asking permission from the operator.


Reminder of the general conditions of sale and the internal and external regulations
The general terms and conditions of sale and the internal and external rules and regulations are modified regularly, particularly when standards, regulations or laws change.
The general terms and conditions of sale, including the privacy policy, the general terms and conditions of use of the website and, where applicable, any special terms and conditions specific to certain offers, constitute the entire agreement between the customer and Mas Gardane S.à r.l., concerning the reservation on the websites and supersede all previous general terms and conditions of sale and internal and external regulations.
Should any of the stipulations herein be declared null and void in whole or in part, for any reason whatsoever, the other stipulations shall remain in force.

The Policy form includes the following information:
 Full names of all occupants (adults and children)
 Date and place of birth
 Nationality
 Usual place of residence
 Mobile phone number and e-mail address
 Date of arrival in the tourist accommodation and expected date of departure.
